TERMS
1. Shipper warrants they are the legal owner of the vehicle or have that they have been duly authorized by the registered owner to enter in to this aggreement.
2. Parties agree that all disputes shall be resolved in accordance with the terms and conditions of this contract and that all outstanding freight charges must be paid at time of delivery.
3. All claims must be noted and signed for at time of delivery, and submitted in writing to the carrier as indicated on the bill of lading within 15 days of delivery.
4. In the event that Shipper cancels this order, prior to the scheduling of a carrier, Shipper shall pay Pride Auto Transport, Inc. (here in after referred to as PAT) a cancellation charge of $50.00 in addition to any other amounts due under this agreement. In the event that Shipper cancels this order after a carrier is scheduled, Shipper shall pay to P.A.T. a cancellation charge of up to $200. If PAT is unable to schedule pickup for transport within ten (10) business days the shipper shall have the option to cancel contract and receive full refund.
5. Shipper upon tender of shipment to PAT or its agent and the consignee on acceptance of shipment from PAT or its agent,shall be liable for all and any unpaid charges.
6. Shipper shall leave no personal belongings in vehicle. In the event shipper does leave belongings PAT assumes no responsibility.
7. Signing the bill of lading from PAT or its subcontractors at destination without notation of specific damages shall be evidence of satisfactory delivery of the vehicle. Claims must be in writing to the carrier within 15 days of delivery with pictures of specific damages. Carrier shall not be liable to owners insurance for any payment made under owners insurance while the vehicle is in the carriers possession.
8. PAT and its subcontractors shall not be responsible for any damages not caused by negligence on their part. Shipper agrees to submit such claims to Shippers insurance.
9. Shipper agrees to prepare the vehicle properly for transport. PAT or its agents shall not be responsible for loose parts,hanging objects, attachments to the vehicle,unsecured batteries and vehicles modified from factory condition.
10. Shipper agrees to pay any additional costs including without limitation, storage,towing,and additional delivery costs incurred as a result of shippers breach of any obligation under this contract, shipper also agrees to hold PAT or its agents harmless for any further costs or obligations caused by said breach.
11. Carrier warrants and shipper acknowledges that PAT is licensed and governed by license # MC 538953.The parties that any legal action resulting from this agreement must be filedin a court of competent jurisdistion within the State of Arizona.
12. This order and any shipment hereunder is governed by PAT's bill of lading and terms and conditions,copies are available at our office.
13. By shippers signature they acknowledge and authorize carrier to transport and drive as necessary vehicle between point of origin and destination as indicated. Owner authorizes carrier and its agents to drive vehicle as necessary for the purpose of loading and unloading.
14. PAT reserves the right to subcontract to its duly authorized and licensed contractors for any and all transport services. Shipper agrees to file claims and and bring legal action only to said carrier.The shipper further agrees to hold PAT harmless from any such action. Insurance and license information for all carriers available upon request.
15. After shipper makes the vehicle available to PAT for transport,PAT shall use its best efforts to deliver the vehicle within Fourteen (14) days.However because unforseeable factors may cause delay PAT can not guarantee date of time or delivery.
16. All vehicles must be presented in operable condition. Shipper agrees to pay an additional $200.00 for each inoperable vehicle,(including those that become inoperable after delivery to P.A.T.)
17. While PAT and its agents are driving said vehicle for purposes of parking,and other purposes incidental to the performance of its obligations under this agreement PAT shall have the full benefit of any insurance that has been affected.
